Privacy policy

§ 1 General information

1. This Privacy Policy defines the rules of processing personal data obtained through the online store shop.zikelabs.pl (hereinafter: "Online Store").
2. The Internet Shop's operator and data administrator is ZiKE Labs sp. z o.o., with its registered office in Rzeszów at Tadeusza Boya-Żeleńskiego 25, 35-105 Rzeszów, entered in the National Court Register kept by the District Court in Rzeszów, XII Economic Department of the National Court Register under KRS no.: 0000609162, NIP: 8133719094, REGON: 364042090 share capital: PLN 5,000.00 (hereinafter referred to as "Administrator").
3. A user is any natural person visiting the Online Store or using one of its functionalities. 
4. Personal data collected by ZiKE Labs sp. z o.o. through the Online Store are processed in accordance with the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free flow of such data and repealing Directive 95/46/EC (General Data Protection Regulation), also known as RODO.

 

§ 2 Type of data processed, purposes and legal basis 

1. Personal data of all persons using the Website (including IP address or other identifiers and information collected through cookies or other similar technologies), and who are not registered Users (i.e. persons who do not have a profile on the Website), are processed by the Administrator:
1) account registration in the Online Store, in order to create an individual account and manage that account. Legal basis: necessary for the performance of the contract for the provision of the Account service (Article 6(1)(b) RODO);

2) placing an order on the Online Store, in order to perform the contract. Legal basis: necessary to perform the contract (Article 6(1)(b) RODO);

3) using the contact form service in the Online Store for the purpose of performing a contract provided electronically. Legal basis: necessary for the performance of the contract for the provision of the contact form service (Article 6(1)(b) RODO);

4) use of the service to post an opinion, in order to perform a contract the subject of which is a service provided electronically. Legal basis - necessary for the performance of the contract for the service to post an opinion (Article 6(1)(b) RODO). 

2. In the case of registration of an account in the Online Store, the Customer shall provide:1) e-mail address.

3. In the case of placing an order in the Online Store, the Customer shall provide the following data:

1) e-mail address;

2) first and last name;

3) address data (postal code, city, street and number of house and apartment;

4) telephone number;

5) the company of the entrepreneur;

6) tax identification number (NIP).

4. When using the contact form service, the customer shall provide the following data:

1) e-mail address;

2) first and last name.

5. In case of using the service of posting opinions, the Customer shall provide the following data:

1) e-mail address;

2) first and last name.

6. For the purpose of establishing, investigation and enforcement of claims, certain personal data provided by the Customer in the use of functionality in the Online Store may be processed, such as: first name, last name, data on the use of services, if claims arise from the manner in which the Customer uses the services, other data necessary to prove the existence of the claim, including the extent of the damage suffered. Legal basis - legitimate interest (Article 6(1)(f) of the RODO), consisting in the establishment, investigation and enforcement of claims and defense against claims in proceedings before courts and other state authorities.

 

§ 3 Period of personal data processing 

1. The period of data processing by the Administrator depends on the type of service provided and the purpose of processing. As a general rule, data are processed for the duration of providing the service or fulfilling the order, until the withdrawal of the expressed consent or filing an effective objection to data processing in cases where the legal basis for data processing is the legitimate interest of the Administrator.
2. The period of data processing may be extended in cases where the processing is necessary for the establishment and assertion of possible claims or defense against claims, and thereafter only if and to the extent required by law. After the expiration of the processing period, the data are irreversibly deleted or anonymized.
 

§ 4 User rights

1. The User has the right to access the content of the data and to request rectification, deletion, restriction of processing, the right to data portability and the right to object to the processing of the data, as well as the right to lodge a complaint to the supervisory authority for the protection of Personal Data.
2. To the extent that the User's data is processed on the basis of consent, this consent can be withdrawn at any time by contacting the Administrator.
3. The User has the right to object to the processing of data for marketing purposes, if the processing is carried out in connection with the legitimate interest of the Administrator, and - for reasons related to the User's particular situation - in other cases where the legal basis for data processing is the Administrator's legitimate interest.

 

§ 5 Information in forms

1. The Service collects information voluntarily provided by the user.
2. In addition, the Service may record information about the parameters of the connection (time stamp, IP address)
3. The data in the form is not made available to third parties other than with the user's consent.
4. Data given in the form may constitute a set of potential customers, registered by the Operator of the Service in the register kept by the General Inspector of Personal Data Protection.
5. Data provided in the form are processed for the purpose resulting from the function of a specific form, e.g. for the process of service request or commercial contact.
6. Data provided in the forms may be transferred to entities technically performing certain services - in particular, this applies to the transfer of information about the holder of the registered domain to entities that are operators of Internet domains (primarily the Scientific and Academic Computer Network j.b.r - NASK), payment services or other entities with which the Operator of the Website cooperates in this regard. 
 

§ 6 Information on cookies

1. The Website uses cookies.
2. Cookies (so-called "cookies") are IT data, in particular text files, which are stored in the Service User's terminal equipment and are intended for use on the Website. Cookies usually contain the name of the website they come from, the time they are stored on the terminal equipment and a unique number.
3. The entity placing cookies on the Service User's terminal equipment and accessing them is the Service operator.
4. Cookies are used for the following purposes:
a. creating statistics that help to understand how the Service Users use the websites, which allows to improve their structure and content;

b. maintaining a session of a User of the Website (after logging in), thanks to which a User does not have to re-enter his/her login and password on each sub-page of the Website;

c. determining the profile of a User in order to display him/her customized materials in advertising networks, in particular the Google network.

5. The Website uses two main types of cookies: "session" cookies and "permanent" cookies (persistent cookies). "Session" cookies are temporary files that are stored on the User's terminal equipment until the User logs out, leaves the website or shuts down the software (web browser). "Permanent" cookies are stored on the User's end device for the time specified in the parameters of the cookies or until they are deleted by the User.

1. Information about certain user behavior is subject to logging at the server layer. This data is used solely for the purpose of administering the site and to ensure the most efficient operation of the hosting services provided.
2. Viewed resources are identified by URLs. In addition, the record may be subject to:
1) Time of arrival of the request,

2) Time of sending the response,

3) The name of the client's station - identification carried out by the HTTP protocol,

4) Information on errors that occurred during the execution of the HTTP transaction,

5) The URL of the page previously visited by the user (referer link) - in case the passage to the Site occurred through a link,

6) Information about the user's browser,

7) Information about the IP address.

§ 8 Data sharing

1. Data shall be made available to external entities only within the limits of the law.
2. Data that allows identification of an individual are made available only with the consent of that individual.
3. The Operator may have an obligation to provide information collected by the Website to authorized bodies on the basis of lawful requests to the extent of the request.
